01 Who operates this website

The website ely-bass.ro is owned and operated by:

Below we refer to the company as "ELY BASS", "we" or "the Provider", and to you as "User", "you" or, where applicable, "Client".

02 Scope of this document

This document sets out the conditions under which you may visit and use ely-bass.ro, including the Romanian-language pages.

By accessing the website or submitting a quote request, you confirm that you have read and accept these terms. If you do not agree with them, please do not use the website.

03 The services presented

ELY BASS provides building digitization and visual marketing services, including:

• 3D scanning with LiDAR technology and point cloud generation;
• Scan-to-BIM, modelling in Revit, ArchiCAD, AutoCAD;
• digital as-built surveys, facade drawings, sections and CAD technical documentation;
• 3D virtual tours and their integration into Google Maps and Street View;
• aerial photogrammetry, georeferenced orthophotos, drone photo and video;
• technical inspections and thermography, for buildings and photovoltaic parks.

The performance figures mentioned on the website (for example ±2 cm accuracy at 10 m, or 99.8% accuracy) refer to normal working conditions and to the equipment we use. They may vary depending on how accessible the building is, on weather conditions and on the complexity of the structure.

Drone flights are carried out in compliance with the aviation legislation in force and with the necessary authorisations, obtained by us before the intervention.

04 Quote requests and contract

• The form on the Contact page is a request for a quote, not an order. Submitting it places you under no obligation;
• We reply with a tailored quote within 48 hours at most from receiving the necessary details. The period refers to working days;
• The initial consultation is free of charge;
• The quote states the price, the delivery deadline, the deliverables and the hosting period for online materials. It is valid for the period stated in it;
• The contract is concluded when the quote is accepted in writing by both parties;
• Prices are expressed in Romanian lei, with VAT indicated separately, in accordance with the law.

05 Deliverables, hosting and archiving

These rules apply to every project and are also stated in the quote:

• The delivered technical files — point cloud (E57, XYZ, RCP/RCS), BIM model (RVT, IFC, PLN), drawings (DWG, DXF, PDF) — remain the client's for good, once payment has been made in full;
• Cloud hosting of the 3D models and virtual tours is included for the period agreed in the quote. We do not offer free "permanent links";
• When the hosting period expires, the online virtual tour is archived. It can be reactivated for a fee, for the period requested, as long as the project remains in our archive;
• An extension of hosting can be requested at any time, for a fee;
• We recommend that the client also keeps a copy of the delivered files.

The client is responsible for providing access to the spaces to be documented and for communicating any security, confidentiality or access restrictions as early as the quotation stage.

06 Intellectual property

Website content

The entire content of the website — texts, structure, graphics, logo, photographs, captures from 3D models, drawings shown, source code and design — is the property of ELY BASS SRL or is used under a lawfully obtained right. It is protected by Romanian Law no. 8/1996 on copyright and related rights.

Without our prior written consent, you may not:

• copy, reproduce or republish the content, in whole or in part;
• use the materials for commercial or advertising purposes;
• modify, decompile or create derivative works;
• extract content automatically through bots, scripts or other automated means, with the exception of search engines that respect the robots.txt file;
• remove copyright notices.

You may quote pages of the website and link to them, provided you credit the source and do not suggest any association with or endorsement by us.

Materials produced for clients

Usage rights over the deliverables are set out in the contract. Unless agreed otherwise:

• the client receives the right to use the deliverables for the purpose for which they were commissioned;
• ELY BASS retains the right to present the work in its portfolio, as a professional reference, only with the client's prior consent. Consent may be withdrawn at any time;
• projects for which the client requests confidentiality are not published.

Third-party trademarks and names

Product names and trademarks mentioned on the website (Matterport, DJI, Revit, ArchiCAD, AutoCAD, Pix4D, Google Maps, Google Street View and others) belong to their respective owners. They are used descriptively only, to show what equipment and software we work with, and imply no affiliation with or endorsement by them.

07 Permitted use of the website

You undertake to use the website in good faith and not to:

• submit false or incomplete data, or data belonging to another person without their consent;
• upload through the form any files containing harmful software;
• attempt to gain unauthorised access to the website, the server or private areas;
• impair the operation of the website through large volumes of automated requests;
• use the website to send unsolicited messages.

We reserve the right to restrict access where these rules are breached, and to notify the competent authorities.

08 Limitation of liability

We make every effort to keep the information on the website accurate and up to date. Nevertheless:

• we do not warrant that the website will be available without interruption or free of errors. Interruptions may occur for maintenance, updates or for technical reasons beyond our control;
• we are not liable for damages arising from the use of general information on the website without first consulting us;
• we are not liable for the temporary unavailability of virtual tours or 3D models hosted on third-party platforms;
• we are not liable for the content of external websites we link to.

Our liability for the work carried out is established by contract and is limited, in all cases, to the value of that contract. We are not liable for indirect damages, such as loss of profit or of business opportunities.

These limitations do not exclude liability in cases where the law does not permit limitation, in particular in the event of wilful misconduct or gross negligence.

09 Links to other websites

The website contains links to external platforms: the virtual tours hosted on 3d-tur.ely-bass.ro, the 3D models on ely-bass.nira.app, videos on YouTube, integrations in Google Maps and our social media pages.

These services have their own terms of use and privacy policies, which we encourage you to read. We do not control and accept no responsibility for their content or practices.

10 Personal data

We process personal data in accordance with Regulation (EU) 2016/679 (GDPR). Full details — what we collect, why, how long we keep it, who receives it and what rights you have — are in the Privacy Policy.

This website sets no cookies and uses no tracking tools. The explanation is in the Cookie Policy.

11 Force majeure

Neither party is liable for failure to perform its obligations where this is due to an event of force majeure or fortuitous event, within the meaning of Article 1351 of the Romanian Civil Code. This includes, without limitation, weather conditions that make flights or scanning impossible, restrictions imposed by authorities and major interruptions of communication services.

12 Governing law and disputes

This document and any legal relationship arising from the use of the website are governed by Romanian law.

We aim to resolve any disagreement amicably. Please write to us first at office@ely-bass.ro — we respond to any complaint within 30 days at most.

If no solution is reached, disputes are settled by the competent courts at the registered office of ELY BASS SRL, in Iași County, Romania, unless the law provides otherwise — in particular in relations with consumers, where mandatory rules on jurisdiction apply.

If you are a consumer within the meaning of consumer protection legislation, the following routes are also available:

Please note that our services are addressed mainly to professionals — companies, design offices, institutions — in which case the relationship is business to business and consumer rules do not apply.

13 Changes

We may update this document at any time, to reflect changes in our services or in legislation. The applicable version is the one published on the website at the time of access, with the effective date shown at the top. We encourage you to re-read it periodically.

If any provision of this document is found to be void or unenforceable, the remaining provisions stay in force.
